1. Scope of application   

The delivery of the products is carried out in Switzerland and worldwide only under the present general terms and conditions. For the sake of simplicity, the customers are referred to therein as customers.

By placing an order in the online shop, the customer agrees to and accepts these terms and conditions.  

2. Contract closure

The products and their prices, which are published in the online shop, are considered as an offer. The contract is concluded with the product order placed online by the customer. The arrival of an order is communicated to the customer by means of an automatically generated order confirmation to the e-mail address provided by him.

The receipt of the automatically generated order confirmation however does not contain any promise that the product is actually available or can be delivered and in which cases no contract is concluded.

3. Delivery, availability of goods  

Delivery in Switzerland is usually made by Swiss Post within 2 to 5 working days. Outside of Switzerland, shipping is handled by DHL and other suppliers and can take between 4 to 9 working days. The shipping costs, as well as any customs duties, taxes or other charges abroad, are borne by the customer.

Shipping cost within Switzerland: 5 CHF (Free of charge for deliveries above 60 CHF)

Shipping costs to the EU: 10 CHF

Shipping cost worldwide (outside CH and EU): 20 CHF

If delivery is refused or an incorrect delivery address is given, the purchase amount will not be refunded. This also applies to goods that are not picked up at the customs – or post office.

If no copies of the selected items are available at the time of ordering, the customer will be informed of this in the order confirmation. If the goods are permanently unavailable, AMANA Beachwear will not accept the order. In this case a contract will not be concluded. The customer will be informed about the fact that the goods are permanently unavailable and no costs will be incurred.  

4. Delivery dates and delivery periods

The information on delivery dates and delivery periods is non-binding.

5. Different delivery address

The customer has the possibility to specify a different delivery address, for example if it is a gift or if the customer is not at home during the day to receive the package. If necessary, the relevant delivery and/or invoice address must be stated when ordering.

6. Complaints and replacement of goods

AMANA Beachwear has to be notified of complaints or faulty products within a maximum of three days. Items that have been damaged due to natural wear and tear, improper use and lack of or incorrect care, cannot be claimed

A contact form is also available for this purpose 

Goods with defects reported in due time are to be returned by the customer, for which AMANA Beachwear will send the customer a printable return label by e-mail upon his request. After receipt of the return, AMANA Beachwear will send the replacement goods to the customer without any costs for the customer.

7. Value-added tax and other duties

All prices for deliveries within Switzerland include the respective statutory value added tax.

This rule does not apply to deliveries abroad. However, the customer is liable for any import taxes, customs duties and any other charges that may be applicable there.

8. Payment

The payment of the ordered goods can be made either by credit card, TWINT, immediate bank transfer or Paypal. AMANA Beachwear reserves the right to exclude certain payment methods in individual cases.

Vouchers

Vouchers or voucher codes provided by AMANA Beachwear cannot be considered after the order process has been completed. The vouchers or voucher codes are also applicable to reduced articles.

9. Return of goods  

Ordered goods can be returned within seven days of receipt.

A return is only permitted if the goods are unused, clean and undamaged in the original packaging including all la-bels, hygiene strips etc.

Before returning an item, it is absolutely necessary that the following contact form is filled out.

A right of revocation is expressly excluded, since Swiss law applicable according to these terms and conditions does not provide such a regulation for online trade.

10. Disclaimer of liability

AMANA Beachwear excludes, to the extent permitted by law and subject to the correction of identified defects, any liability for any direct or indirect damages incurred by the customer within the scope of the contractual relationship.

11. Intellectual property rights

The amanabeachwear.com website includes formats and content that are protected by trademark and copyright laws. The customer is not allowed to edit, duplicate, distribute, publicly reproduce, advertise or otherwise use the website and the content provided therein or individual parts thereof. AMANA Beachwear is deposited and registered in Switzerland at the Institute of Intellectual Property as a protected trademark.

12. Data protection

The data protection is regulated in the AMANA Beachwear privacy policy.

13. Validity

The prices shown on the website are subject to change at any time and without notice. The same applies to these general terms and conditions.

14. Applicable law and place of jurisdiction

Place of performance and jurisdiction is Zurich. The contractual relationship between the customer and the company of AMANA Beachwear is exclusively subject to Swiss law. The UN Convention on Contracts for the International Sale of Goods is not applicable.
